Text | "In the name of God Amen I Christopher Croft of Stillington in the County of York Gentleman being mindfull of my Mortality do make this my last Will and Testament concerning my Reall and Personall estate which I now have or shall be possessed of at the time of my death in manner following I give and devise all my Rectory of Great and Little Broughton in the County of York with all the Rights and Appurtenances to the same belonging also all my Lands Tenements Hereditaments and Premisses whatsoever with all and singular their Appurtenances situate lying and being in Great and Little Broughton aforesaid and also all that my House and all my Closes Lands Tenements and Hereditaments whatsoever situate lying and being in Stillington aforesaid unto my Nephew Stephen Croft of Oporto Esquire and his Heirs for ever nevertheless subject and chargeable with the payment of one [?]ear annuity of yearly rent charge of thirty pounds of lawfull money of Great Britain to be yearly issuing and going out of all and singular the said Premisses and to be paid unto my welbeloved Sister Olive Huntington of Melton in the said County of York Widow for and during the term of her natural life by two half yearly payments the first payment thereof to begin and be made at the end of six months next after my death And my will and mind is that if the said annuity or yearly rent charge of thirty pounds or any part thereof shall happen so to be behind and unpaid by the space of fforty days next after any of the said days on which the same ought to be paid that then it shall and may be lawfull to and for my said Sister Olive Huntington and her Assignes into all and singular the said Premisses at Great and Little Broughton and Stillington aforesaid or any part or parcell thereof to enter and distrain for the said an[n]uity or yearly rent of thirty pounds and also for the arrearages thereof if any shall be and the distress and distresses there so taken to lead drive and carry away and the same to detain and keep untill my said Sister Olive Huntington and her Assignes of the said annuity or yearly rent charge of thirty pounds and of the arrearages thereof and of every part and parcell thereof with all costs and charges in and about the same shall be fully satisfyed and paid Also I give and devise unto my said Sister Olive Huntington the sum of fifty pounds for mourning Also I give and devise unto my Brother John Croft the sum of fifty pounds foor mourning Also I give and devise unto my Sister Nancy Hilliard [i.e. Hildyard] one shilling Also I give and devise unto my Nephew Christopher Croft the sum of four hundred pounds to be paid him at his age of one and twenty years Also I give and devise unto my Nephew Christopher Huntington the sum of two hundred pounds to be paid him at his age of one and twenty years and in the mean time that the interest thereof at the rate of [five?] pounds [per?] the hundred for the said two hundred pounds shall be paid him quarterly and the said quarterly payment thereof to begin and be made at the end of three months next after my death untill [he] attains his age of one and twenty years to find him with Cloths and necessarys during his Apprenticeship Also I give and devise unto my Mother ten pounds for mourning Also I give and devise the sum of five pounds to be distributed equally amongst the poor of Stillington by the Churchwardens and Overseers of Stillington after my funerall And I request my Executor that I may be privately interred and carried by eight of my own and Nephew Stephen's Tenants giving each of them a pair of Gloves and five shillings apeice in money Also I give and devise unto my welbeloved friendnds Doctor Gouge Mr. William Stainforth and Henry Thompson Esquire to each of them a Ring at a Guinea [in] value and I request the said Henry Thompson in the absence of my said Nephew Stephen Croft that he will see this my Will performed in every point And lastly after the payment of my debts annuity and legacies herein above by me charged and given as aforesaid then all the rest and residue of my Personall Estate Mortgages Bonds [Notes?] of what kind soever the same are I give and devise unto my said Nephew Stephen Croft whom I nominate and appoint sole Executor of this my last Will and Testament hereby revoking all former Wills by me heretofore made In witness whereof I have hereunto set my hand and seal the ninth day of October in the year of our Lord one thousand seven hundred thirty and seven ~ Chr: Croft ~ Signed sealed published and declared by the Testator to be his last Will and Testament and be it remembred that the word five was first interlined in the presence of Joahanna [Maw?] Grace Marshall Jos: Hewan ~ This Will passed the Seal of Court the 13th day of April 1739." | |
