Text | "This is the Last Will and testament of me Edward Brettell of the Township of Cradley in the Parish of Hales Owen in the County of Worcester Gentleman First I order and direct that all my just debts funeral and testamentary shall be fully paid and discharged by my Executors hereinafter named out of my Personal Estate I give and devise unto my Nephew James Brettel of the Parish of Oldswinford in the said County of Worcester Bricklayer All those three Closes Pieces or Parcels of Land adjoining together and called Light Green Closes Situate and being in the Township of Cradley aforesaid part thereof adjoining the Common Highway leading from Cradley aforesaid to Cradley Heath and Netherend Also all the Several Messuages or Dwellinghouses Nail Warehouses and Buildings that now are or shall or may at the time of my decease be standing and being thereon And also all that Messuage or Dwellinghouse Shop Garden and Premises Situate and being at a place called the Wardens in the Township of Cradley aforesaid and now in the occupation of John Allen to hold All and Singular the said Land Messuages and Hereditaments unto and to the use of the said James Brettell his heirs and Assigns for ever Subject nevertheless to and I do hereby expressly charge the same with the Payment of the four Several Yearly rent Charges or Annual Sums of ten Pounds each to the following persons (that is to say) my Brother Joseph Brettell Ann Brettell his Wife my Brother in law Edward Cox and also to Sarah his Wife And I direct the said James Brettell his heirs or Assigns to pay the same four Several Yearly Sums to the said Several persons respectively during the term of their respective lives by quarterly Payments the first quarterly Payment thereof to commence and be made at the expiration of three Calendar months next after my decease And in case of nonpayment when due I hereby empower the said persons respectively to recover the said Yearly Sums and all Costs and Charges of such recovery by distress and Sale in the same manner as rents in Arrear on Common demises are recoverable by law Also I give and devise unto my Nephew Samuel Brettell of Cradley aforesaid Bricklayer all those two Messuages or Dwellinghouses with the Shop and Gardens belonging to the same and also a Small Piece of Land Situate and being at a place called the two Gates in Cradley aforesaid and now in the occupations of Joseph Harper the Elder and the Widow Lewis to hold the same unto and to the use of the said Samuel Brettell his heirs and Assigns for ever Also I give and devise unto my Nephew George Brettell of the Parish of Oldswinford Bricklayer the Messuage or Dwellinghouse Outbuildings Garden and Premises now in my own occupation Situate at Cradley aforesaid to hold the same unto and to the use of the said George Brettell his heirs and Assigns for ever Also I give and devise unto my Niece Charlotte Pershouse Wife of William Pershouse of the Parish of Clent in the County of Stafford Maltmaker all those two Messuages or Dwellinghouses Shops Gardens and Premises now in the occupation of Joseph Harper the Younger and Thomas Cox Situate at the two Gates in Cradley aforesaid and adjoining the said Messuages and Premises hereinbefore devised by me to my said Nephew Samuel Brettell to hold the same unto and to the use of the said Charlotte Pershouse her heirs and Assigns for ever Also I give and devise unto my Niece Mary Allen Wife of Thomas Allen of Birmingham in the County of Warwick Builder All that piece or parcel of Land containing by estimation two Acres and an half Situate and being at or near the two Gates in Cradley aforesaid and now in the tenure or possession of Richard Bache to hold the same unto and to the use of the said Mary Allen her heirs and Assigns for ever Subject nevertheless to and I do hereby charge the same with the Payment of the Sum of Fifty Pounds unto my Niece Elizabeth Latheram Wife of Edward Latheram of Birmingham aforesaid And I direct the said Mary Allen her heirs Executors or Administrators to pay the said Sum of Fifty Pounds unto the said Elizabeth Latheram within twelve Calendar Months next after my decease Also I give and devise unto my Niece Elizabeth Lees Wife of George Lees of Birmingham aforesaid Plater all that piece or Parcel of Land called Paradise Situate and being in Cradley Field near the two Gates aforesaid containing by estimation one acre and an half and now in the tenure or possession of Richard Bache to hold the same unto and to the use of the said Elizabeth Lees her heirs and Assigns for ever Also I give and devise unto my Niece Hannah Hingley Wife of Samuel Hingley of the Parish of Rowley Regis in the said County of Stafford Gunbarrel welder all that Messuage or dwellinghouse Pigstye and Garden now in the occupation of Thomas Clewes and also another Garden adjoining thereto in the occupation of John Whyes all which said Messuage Gardens and Premises are Situate and being at a place called Colley Gate in Cradley aforesaid to hold the same unto and to the use of the said Hannah Hingley her heirs and Assigns for ever Also I give and devise unto Joseph Meredith of the Lye in the Parish of Oldswinford aforesaid Bricklayer all that Messuage or dwellinghouse Garden and Premises now in the occupation of James Westwood Situate and being at Colley Gate aforesaid and adjoining the last mentioned and devised Messuage and Premises to hold the same unto and to the use of the said Joseph Meredith his heirs and Assigns for ever Also I give and devise unto Joseph Meredith of Cradley aforesaid Scythesmith all that piece or parcel of Land containing by estimation one acre and an half Situate and being at or near Colley Gate in Cradley aforesaid and now in the tenure or possession of Stephen Beasley to hold the same unto and to the use of the said last mentioned Joseph Meredith his heirs and Assigns for ever Also I give and devise unto Mary Meredith of Cradley aforesaid Spinster all that Messuage or dwellinghouse adjoining the Messuage and Premises to the same belonging Situate and being at Colley Gate in Cradley aforesaid and now in the occupation of the said John Whyes To hold the same unto and to the use of the said Mary Meredith her heirs and Assigns for ever Also I give and devise unto Thomas Smith and Ann his Wife all that Messuage or dwellinghouse Shop Garden and Premises Situate and being at Colley Gate in Cradley aforesaid and now in their own occupation to hold the same unto the said Thomas Smith and Ann his Wife during the term of their joint natural life and the life of the Survivor and longer liver of them And from and after the decease of the Survivor I give and devise the same unto the four daughters of the said Thomas Smith and Ann his Wife to hold the same unto and to the use of them their heirs and Assigns for ever as tenants in common and not as joint tenants Also I give and bequeath unto my Nephew Joseph Wood of Bilston in the County of Stafford Castor one Share in the Stourbridge Canal Navigation as his own absolute property Also I give and bequeath unto my Sister Hannah Swipson Widow and my Nephew Edward Brettell Tavernkeeper both residing in London one other Share in the Stourbridge Canal Navigation the same to be equally divided between them Share and Share alike Also I give and bequeath unto my Nephew [—] Brettell the only Son of my late Brother Thomas Brettell deceased and who as it is supposed is now residing in some part of the County of Hereford one Share in the Dudley and Netherton Canal Navigation as his own absolute property Also I give and bequeath unto my Niece Ann the Wife of Richard Wilkes of Birmingham aforesaid Glass stainer one Share and a quarter of a Share in the said Dudley and Netherton Canal Navigation as her own absolute and disposable property Also I give and bequeath unto the trustees of Park Lane Chapel belonging to the Protestant Dissenters in Cradley aforesaid one other Share in the Dudley and Netherton Canal Navigation and I direct the Interest or dividends arising therefrom to be by them and their Successors for the time being paid or applied to or for the use of the resident Pastor or Preacher from time to time of the said Chapel Also I give and bequeath unto the two Sons and one daughter of my late Sister Ann Sparkes all of whom reside in London the Sum of Fifty Pounds [such?] to be paid to them respectively by my Executors out of my Personal Estate at the end of Six months next after my decease Also I give and bequeath unto my Housekeeper Hannah Cox Homer the Sum of thirty Pounds to be paid to her by my Executors in Six months next after my decease Also I give and bequeath all my Household Goods and Furniture Plate Bedding Linen China Monies Securities for money debts and the residue and remainder of my Personal Estate and Effects unto and amongst all the Children Sons and daughters of my said Brother Joseph Brettell the same to be equally divided between and among them Share and Share alike And I do hereby constitute and appoint my said Nephew James Brettell and Michael Pratt Reading of Cradley aforesaid Executors of this my Will to the latter of whom I bequeath the Sum of Five Pounds And I give devise and bequeath all the Estates and Hereditaments vested in me on any trusts or by way of Mortgage and which I have power to dispose of this my Will with their Appurtenants unto the said James Brettell and Michael Pratt Reading their heirs Executors Administrators and Assigns Upon trust to hold or dispose of the said trust Estates in the manner in which they ought to be held or disposed of pursuant to the said trusts and upon Payment of the money Secured by or upon any such Mortgages which when received shall be considered and taken as part of my Personal Estate to convey or Assign the Estates so in Mortgage to the person or persons entitled thereto for the time being And I revoke all former Will and Wills and testament In Witness whereof I the said testator Edward Brettell have at the bottom of the three first Sheets of this my Will (the whole whereof is contained in four Sheets of Paper) Subscribed my Name and to this fourth and last Sheet thereof Subscribed my name and affixed my Seal and Published and declared this to be my last Will and Testament the twenty Second day of July in the Year of our Lord One thousand eight hundred and twenty Six Edwd. Brettell The Writing contained in this and the three preceding Sheets of Paper was Signed and Sealed by the said testator Edward Brettell and by him Published and declared as and for his last Will and testament in the presence of us who at his request in his presence and in the presence of each other have hereunto Subscribed our names as Witnesses Wm. Fellowes Sen. Atty. Dudley Phebe Fellowes Thos. Orme Proved at London 28th July 1827 before the Judge by the oaths of James Brettell the Nephew and Michael Pratt Reading the Executor to whom Adm[inistrati]on was granted having been first Sworn (by Commission) duly to Administer." | |
